The Numa Member status programme ("status programme") of Numa Group GmbH and its respective domestic subsidiaries (Numa Deutschland GmbH, COSI Hamburg Süd GmbH, COSI Köln Nord GmbH, COSI Köln West GmbH, Numa Österreich GmbH, Numa Belgium Central SRL, Numa Belgium North SRL, YAYS Frankrijklei BV, Numa Schweiz GmbH, numa Prague s.r.o., Numa Danmark ApS, numa stays España S.L., NUMA France S.A.S., YAYS Issy S.A.R.L.., Numa Italia S.r.l., Numa Nederland B.V, Numa Nederland Operations B.V, Numa Norge AS, numa Portugal unipessoal Lda, numa stays UK Ltd, numa Oxford Ltd and Native Places Ltd)("Numa") rewards registered guests (“Numa Members’) for their participation. Once Numa Members complete a direct booking through a Numa Website, the below benefits might apply. The status programme is governed by these basis for a terms of participation.
1. Which Hotels?
The status programme is offered for all hotels operated by Numa at the time of the respective stay. Benefits offered vary from hotel to hotel.
2. How to participate?
2.1. Conditions of Participation
All persons who are legal adults or legally competent according to the laws of the country in which they reside are able to participate, once they have gone through the sign up process defined below. The status programme cannot be used by anyone other than the individual Numa Members. Participation in the status programme cannot be transferred to another person.
2.2. Sign Up Process
Participation in the status programme can be obtained in the following ways:
When registering, all required fields must be answered truthfully and in full. To participate, a valid email address must be provided. There is no possibility to use the same email address for two Numa Members. Numa Members may not share their password with third parties and are responsible for the use and confidentiality of their login data. Changes to the email address, name or other relevant information can be made directly by the Numa member in their account. The participation in the status programme will be confirmed via email.
2.3. Consent to receive newsletters and other information
When signing up to be a Numa Member, the guest agrees to receive advertising material (electronic messages about the programme, i.e. general information, overview of bookings, personalised information and tailored offers, etc.). The member also explicitly consents to the collection, processing and use of their personal data by Numa as required for the execution of the status programme, as well as in the context of bookings and for the transmission of regular information about news, promotions and offers of Numa related to hotels and travel via email, text, WhatsApp or other electronic media. Explicit consent is also given to the use of personal data for targeted advertising purposes on Numa operated websites as well as on social media platforms. Should the Numa Member no longer wish to receive such information, they are able to unsubscribe via the ‘Unsubscribe’ link at the end of each marketing email.
2.4. Cost
By being a Numa Member, consent to receive newsletters and other information from Numa is given. No other costs are incurred by participating in the status programme.
3. What are the benefits?
When conducting the booking through the Numa account (on Numa website or via the app), the following benefits are offered (always subject to availability and local regulations):
Numa Members are responsible for informing Numa that they are members in order to receive the benefits.
4. How to cancel?
4.1. Cancellation by Numa Member
Each Numa Member can cancel participation in the status programme with immediate effect at any time by deleting their Numa account.
4.2. Cancellation Numa
Numa reserves the right to cancel each participation in the status programme for good cause without notice and without compensation. Cause for cancellation includes violation of these general terms and conditions, the general terms and conditions applicable to the participating hotels, provision of false information, and any inappropriate or criminal conduct (in particular unpleasant, malicious or offensive behaviour toward hotel staff or guests) by the member.
4.3 Court ruling
Should the status programme have to be discontinued due to conditions pertaining to a country’s legislation, a court decision or a prohibition by a country’s public authorities, Numa will not be held responsible for any losses to the individual Numa Member that may ensue from this cancellation.
5. Liability
Numa is only liable for damages incurred by the Numa Member in connection with the programme if the damages are due to intent and gross negligence. Any compensation for damages is limited to the amount of the typically foreseeable loss. The above limitation of liability does not apply in the case of loss of life, bodily injury or damage to health, claims under the Product Liability Act, and insofar as the law prohibits such limitations.
6. Changes to the status programme and the conditions of participation
6.1. Changes to the Conditions of Participation
These Conditions of Participation can be changed in part or in full by Numa at any time. If changes affect the rights and obligations of Numa Members substantially, Numa Members will be notified of this prior to enactment of the changes.
6.2. Changes of benefits
Numa reserves the right to change or withdraw the benefits specified under clause 3 in part or in full at any time in accordance with clause 6.1.
7. Data Protection
By registering for the status programme, Numa Members declare their consent to the use of their personal data in accordance with the data protection provisions under https://numastays.com/privacy.
8. Acceptance
By registering for the status programme, Numa Members accept these Conditions of Participation as well as the General Terms and Conditions of Numa for all future bookings as a member. The present Conditions of Participation replace any previous agreements and are subject to German law without prejudice to any mandatory protective provisions applicable in the country of residence of the consumer. The place of jurisdiction is Berlin.
